  • Contact BorCon
  • Engage with BorCon and sign SERVICE LEVEL AGREEMENT
  • Send all relevant requested documentation to BorCon
  • Place BorCon in funds at the agreed amount
  • +-1 week later you will receive an OPINION on the strength of your case.
  • +- 1 week later you will receive a STRATEGY on how best to move foward.
  • During the same time NOTICES etc will be issued.
  • BorCon as your representative becomes the first point of contact.

TIME: +- 2 WEEKS

  • NOTICE OF DISAGREEMENT - DAY 1
  • Latest day to RESOLVE disagreement - DAY 11
  • NOTICE OF DISPUTE (if not resolved) - DAY 12
  • Propose names of ADJUDICATORS - DAY 12
  • Ask the nominating body to appoint - DAY 17
  • Adjudicator accepts appointment - DAY 30
  • Statement of Claim (SOC) - DAY 45
  • Statement of Defence (SOD) - DAY 60
  • Replication - DAY 65
  • ADJUDICATOR ISSUES AWARD - DAY 90

TIME: +- 3 MONTHS

ARBITRATION

  • Pre-arbitration engagements 1-3 Months
  • Pleadings & Discovery period 3-6 Months
  • Hearings 1-2 Months
  • Deliberations and Final award 1-3 Months
